Six things worth checking in an employment contract

What you agree not to do after you leave.

Non-compete and non-solicit wording has three parts worth reading together: how long, how wide geographically, and which kinds of work it covers. Whether such a clause holds up varies a great deal by location.

Pay that is described as discretionary.

Bonus, commission and variable pay are often written so that nothing is owed unless the employer decides. Worth asking how it is calculated, and what happens if you leave mid-period.

Notice that is not symmetrical.

Worth comparing the notice you would have to give with the notice you would receive. If the two differ, that is a fair thing to raise before signing.

Ownership of what you make.

Some IP clauses reach beyond work hours and company equipment to anything related to the employer's field of business. A common thing to ask for is a carve-out for personal projects.

Money you might have to pay back.

Signing bonuses, relocation costs and training fees are often repayable if you leave within a set period. Worth knowing the period and whether the amount reduces over time.

How a dispute would be handled.

Mandatory arbitration and class-action waivers change where a disagreement is heard and what it costs. This is usually a single short paragraph near the end.

Is the employment contract review free?

Will it tell me whether my non-compete is enforceable?

No. Enforceability depends on where you work and on facts outside the document, and that is a question for a lawyer. What you get is what the clause says — how long, how wide, and what it covers — so you know what you would be agreeing to.

Can I review an offer before I accept it?

That is what the page is for. The analysis works on an offer letter, a full employment contract, or both together.

What about a contractor agreement instead of employment?

Is my offer private?
